Cox Tract is a 116-acre mixed-use product that includes single-family homes, multifamily units, and commercial space. Again here, the commercial and single-family were welcomed while the multifamily component caused the backlash.

Commissioner Matthew Blanscet expressed concern about the height of the proposed multifamily buildings and their proximity to existing homes, and Commissioner Clemens and Walden had a “problem” the multifamily component.

Chair Kelly Patterson-Herndon was willing to pass the proposal without the multifamily, saying:

Unique to this product was the Developer's request to base multifamily parking on 15% of the lot size rather than the number and size of units. They also proposed increasing the required landscape buffer between multifamily and adjacent homes from the standard 10 feet to 20 feet.

Several residents expressed concerns during the public hearing. Melinda Harp worried about increased cut-through traffic and speeding and Todd St. Pay highlighted the existing difficulties accessing the elementary school on CR 371 due to congestion. Kevin Susi, who has lived in apartments, cautioned about crime.

Ultimately, the Commission unanimously voted to deny the rezoning request. The developer did not revise the proposal to remove the controversial multifamily portion, leading to the product's rejection, despite the potential fiscal benefits presented, such as more than double the 30-year property tax revenue compared to the current agricultural zoning.
