The applicant was Evan Jarvis, who requested rezoning a 4.88 acre property located at 4812 Waldemar Street from its current "D" Duplex District zoning to "MF-1" Multifamily Residential District. The property is currently being used as a multifamily residential complex with 88 apartments, even though it is zoned for duplexes.

The rezoning request received unanimous denial from the Planning & Zoning Commission at their August 9th meeting, with a 6-0 vote. Their concerns seemed to be that the property did not meet the development criteria for MF-1 or MF-2 zoning, as Planning Director Glenna Batchelor explained:

Part of the reason for the denial was that it was a straight rezoned multifamily. Y'all have passed to you comparison of the MF-1 and MF-2. They don't meet the development criteria of either one of those so that was the reason for P&Z's denial of the case.

At the Council meeting, the rezoning request continued to receive pushback. Council Member Eric Morris said he was initially "lost" and did not understand the impact or benefit of approving the request. Council Member Don Cooper also expressed confusion over why the rezoning was needed when the property was already operating as multifamily apartments.

The applicant's representative, Kevin Jarvis, tried to justify the request by explaining it was needed to bring the property into conformance for bank financing, since the bank had already approved a loan expecting it to be zoned multifamily. However, the council and staff reiterated that straight rezoning would not resolve the non-conformity issues. Planning Director Batchelor stated:

I support P&Z's decision to deny it and that's what I'm trying to get in you you're okay. That's what I'm trying to understand. Okay. Thank you. They're gonna resubmit with a plan development for what is there on the ground current day.

In summary, the rezoning request received negative feedback and pushback from both the Planning & Zoning Commission and City Council due to concerns over non-conformity with multifamily development criteria.
