This item was a request by developer Allen Harrison to rezone 18 acres at the southwest corner of McKinney Ranch Parkway and Collin McKinney Parkway from PD to PD, to allow for 385 multi-family units at a density of 38 units/acre.

The request received extensive negative feedback from the Commission. Commissioner Brian Manza expressed serious concerns with exceeding the standard 30 unit/acre density.

We're giving certain things away and what are we getting, what are we getting in return? And what I see is an apartment with 21 garage doors side by side all the way down.

He also objected to the requested deviations from parking, fencing and other standards.

Commissioner Scott Wilson echoed concerns about density.

I have a problem with the overall site plan of 42 garage doors surrounding the apartment and a reduced parking ratio and getting river perimeter fences while getting just your standard regular four story apartment.

The developer, Kevin Kuntz of Allen Harrison, explained the need for increased density due to road right-of-way dedications and floodplain encroachments constraining the developable area.

In response to parking concerns, Kuntz stated:

Based on our development experience, 1.6 is really the minimum that we require on our developments in order to maintain, you know, a satisfactory resident experience.

Regarding fencing, he stated that the reason is to create a “softer physical barrier” as you approach the property.

No community members provided public comments on the item.

In the end, the developer requested the item be tabled indefinitely to allow time to address the concerns raised by the Commission. The tabling was approved unanimously.

Central Expressway I1 3298 N Central Expy

This item was a request by developer Woodhaven Commercial Development to rezone 5.4 acres at 3200 N Central Expressway from C Planned Center to I1 Light Industrial.

The request received negative feedback from Commissioner Brian Manza, who expressed concerns about allowing light industrial zoning on the US 75 service road, stating:

I have concerns here putting light industrial, the first piece that we'd have on 75, compared to a C3." He noted that "City Council has kind of set the precedent that light industrial is a stretch on a 75 service road.

Developer Rob Dye explained the intent is for a high-quality business park with smaller warehouse, office and showroom spaces, stating "On the front edge we did want to still stick with one of those smaller, uh, kind of retail friendly, uh, you know, office type looking buildings." In response to screening concerns, he stated "Our thoughts there were how do we be intentional to kind of hide that, that use, um, back there to give a better visual appeal and aesthetic, uh, to this area."

No community members provided public comments.

The request was approved 6-1, with Commissioner Manza voting against. Manza reiterated concerns about uses allowed by light industrial zoning but said he would vote in favor since two council members were present to hear concerns.

He stated "I'll vote to move it on favorably. So what me[my vote] says is I've said my concerns and we're simply an advisory here as far as that goes.

2018 Zoning Code Change

A rezoning request from the September 12 Planning and Zoning meeting brought a 2018 zoning code change up that we thought you should know about.

A 10.9-acre property had been previously approved for a mixed-use development including multifamily housing under BN - Business Neighborhood zoning.

In 2018, the City of McKinney updated its zoning ordinance to disallow residential uses in certain commercial districts including BN. However, projects approved prior to that change were allowed to proceed under legal non-conforming status. To bring the multifamily component into conformance with current codes, a rezoning request to a PD district needs to be approved.

Some more details on the 2018 zoning code change by the City of McKinney:

  • In 2018, the City of McKinney adopted amendments to the zoning ordinance that removed allowances for residential uses in certain commercial zoning districts.

  • One of the zoning districts affected was BN - Business Neighborhood. Prior to 2018, multifamily residential uses were allowed in BN districts.

  • The intent of the code change was to clarify that BN is intended for commercial uses and to disallow standalone residential or mixed-use with residential components in BN zoning going forward.

  • However, any residential developments that had already been approved in BN prior to the code change were allowed to proceed under "legal non-conforming" status.

  • This meant projects with residential in BN that had already received zoning, site plan, or building permits could continue, but new standalone residential would no longer be allowed in BN.
