With the 322-unit Shell Craft Development, an early denial at P&Z led to denial at Council.

Council Member B.W. Smith, District 5, pointed out the unusual 7-0 vote by the Planning & Zoning Commission to deny the application, suggesting that they saw or heard something significant to warrant such a decision.

Apparently on this [application] they saw or heard something that caused their vote to be 7-0 to deny, and that's usually pretty unusual.

Council Member Kenny Green, District 2: While Green saw potential for the project, he also criticized the current layout, stating that from I-20 and Lawson Road, it would appear to be mostly concrete, with parking on the exterior facing the main roads. He suggested:

So I think there is some opportunity to retool it, perhaps maybe putting some more retail on the front and droid there, because that would not only serve any kind of multifamily you could add there, but it would also provide some of the services on the neighborhood.

Positive:

Council Member Jeff Casper, District 1: recognized the potential for the project to be retooled and reshaped to incorporate multifamily housing while also providing a footprint for retail and sit-down restaurants that the neighborhood desires.

I, like Councilman Burroughs, hear some possibility that if this can work. It's got to be significantly retooled and reshaped, but there might be some capacity to work in multifamily, to make retail, have a footprint to service the neighborhood with the restaurants. Especially sit-down restaurants that we're wanting.

Council Member Green acknowledged that the property would inevitably be developed and saw an opportunity for the applicant to work with staff to create a plan that would be more acceptable to the neighborhood.

I think there is a happy medium here. I'm not opposed to multifamily there, but the layout that you guys have proposed here with the number of units, the way it's kind of chopped up, just kind of a weird layout.

In response to the feedback, Jake Bloom, representing the development group, expressed a willingness to work with the community and address their concerns.

He also mentioned the possibility of introducing more retail, reducing multifamily units, improving amenities, and using design techniques to minimize impacts on nearby residential areas.

Denied

There were a few key reasons the Commissioners voted to deny zoning Pawan Bagaria’s 322-unit product in Southeast Mesquite.

Traffic Impact Commissioner Dharmarajan stated:

I guess quite a few have spoken already with respect to the traffic which is which is an issue to be contented with.

And the crime aspect of it I cannot speak to it but you got to go by their experiences.

Resident Jaime Quiroz spoke against it saying:

It brings a lot of crime. I don't want that.

I don't think your infrastructure is going to be able to handle more apartments than you already have, schools, your police. I just don't think that it's going to be able to handle it.

Property Value/View Concerns Resident Jonathan Beck said:

You ask yourself, why don't they build something like this somewhere off the highway? They want it on the highway, so everybody sees it, right? My property is right on the highway and nobody would be able to see it if they built these gigantic three-story buildings.

The Commissioners took into account these resident concerns and made their decision to deny it.
